These Terms of Service ("Terms") govern your access to and use of the Twake Workplace website, applications, and services (collectively, "Services"). If you do not agree with any part of the terms, you are prohibited from using or accessing this site and its services. By agreeing to these Terms, you represent and warrant that you are of legal age to form a binding contract with LINAGORA and that you meet all other eligibility requirements outlined herein. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and you hereby agree to be bound by these Terms on behalf of that organization. Access to and use of our Services is void where prohibited by law.

Account Terms
  • Account Creation
To access certain features of Twake Workplace, you must register for an account. When creating an account, you agree to provide accurate, current, and complete information as prompted by the registration form, and to update such information to keep it accurate, current, and complete. LINAGORA reserves the right to suspend or terminate accounts that are suspected of containing inaccurate, outdated, or incomplete information.
  • Account Responsibilities
You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. LINAGORA cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation. You must notify LINAGORA immediately upon becoming aware of any breach of security or unauthorized use of your account.
  • Account Use
You may not use the Services for any illegal or unauthorized purpose, nor may you, in the use of the Services, violate any laws in your jurisdiction (including but not limited to copyright laws). You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission by LINAGORA.

We strive to update and improve our Services continually, and the specific features and functionalities available to you may evolve over time.
  • Support Services: If you encounter any issues or have questions regarding the use of Twake Workplace, our support team is available to assist you. We provide comprehensive support resources, including a searchable knowledge base, user guides, and direct support through our helpdesk. Support availability and response times may vary depending on the level of service you have subscribed to.

User Responsibilities
As a user of Twake Workplace, you agree to comply with the following responsibilities:
  • Legal Compliance: You must use the Services only for lawful purposes and in accordance with these Terms. This includes not using the Services to send, store, or distribute any material in violation of third-party privacy rights or that is unlawful, harassing, libelous, threatening, obscene, indecent, would violate the intellectual property rights of any party or is otherwise unlawful.
  • Account Integrity: You are responsible for all activities that occur under your account and must keep your account information and password secure. You should inform LINAGORA immediately of any unauthorized use of your account or any other breaches of security.
  • Content Management: You retain full responsibility for the content that you upload, post, email, transmit, or otherwise make available through Twake Workplace. You must ensure that your content complies with all applicable laws and does not infringe on any third-party rights.
Termination and Suspension
  • Termination by You: You may discontinue use of our Services at any time. To terminate your account formally, please follow the instructions provided in your account settings on Twake Workplace. Upon termination, your account will be deactivated, and you will no longer have access to the Services.
  • Termination by Us: LINAGORA reserves the right to terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms. Upon termination, your right to use the Services will cease immediately. If you wish to terminate your account, you may simply discontinue using the Services.

Effect of Termination: Upon termination, all provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Changes to Terms and Services
  • Changes to Terms: LINAGORA reserves the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide a notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
  • Changes to Services: We are constantly updating our offerings of Services, and the Services may change over time. LINAGORA may add, alter, or remove functionality from a Service at our discretion without prior notice. We may also limit, suspend, or discontinue a Service at our discretion. If we discontinue a Service, we will give you reasonable advance notice to provide you with an opportunity to export a copy of your Content from that Service.

Disclaimer of Warranties and Limitation of Liability
  • Disclaimer of Warranties: You expressly understand and agree that your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. LINAGORA and its affiliates, subsidiaries, officers, directors, employees, agents, partners, and licensors expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Furthermore, LINAGORA does not warrant that the Services will be uninterrupted, timely, secure, or error-free. LINAGORA also does not guarantee the safety or preservation of data; data loss or corruption may occur, and LINAGORA disclaims any liability for such occurrences. Nor does LINAGORA make any warranty as to the results that may be obtained from the use of the Services.

Limitation of Liability: To the fullest extent permitted by applicable law, LINAGORA and its affiliates, subsidiaries, officers, directors, employees, agents, partners, and licensors will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if LINAGORA has been advised of the possibility of such damages), resulting from the use or the inability to use the Services.

Governing Law
These Terms of Service shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
